KOOLMD Telemedicine Disclaimer, Patient Safety & Privacy Notice

KOOLMD provides access to healthcare professionals and healthcare-related services through telemedicine and other digital technologies. Telemedicine allows patients to communicate with healthcare professionals remotely through secure video, audio, messaging, electronic medical records, and other available technologies.

Telemedicine is not a substitute for emergency medical care and may not be appropriate for every medical condition or every patient. A telemedicine encounter also may not provide the same information, physical examination capabilities, diagnostic testing, or clinical observations that may be available during an in-person examination.

By using KOOLMD, you acknowledge and understand that remote healthcare has inherent limitations, including limitations associated with technology, internet connectivity, audio or video quality, the inability to perform certain physical examinations, incomplete or inaccurate information supplied by a patient, and the inability to immediately perform certain laboratory, imaging, diagnostic, or other procedures.

Where a healthcare professional determines that an in-person evaluation, diagnostic testing, emergency evaluation, specialist consultation, or other form of care is appropriate, you may be directed or advised to seek such care.

KOOLMD is not an emergency department, emergency medical service, hospital, ambulance service, or replacement for emergency medical care.

DO NOT use KOOLMD for a medical emergency. If you believe you are experiencing a medical emergency, call 911 immediately or go directly to the nearest emergency department or hospital.

Examples of potentially serious symptoms may include, but are not limited to, severe chest pain or pressure, difficulty breathing, severe bleeding, sudden weakness or paralysis, sudden difficulty speaking, loss of consciousness, severe allergic reaction, seizure, serious injury, severe abdominal pain, suicidal thoughts or an immediate risk of harm to yourself or another person, or any other condition that you reasonably believe may require immediate medical attention.

Do not wait for a KOOLMD appointment, message, callback, prescription, laboratory result, or response from a healthcare professional when emergency care may be necessary.

If you are uncertain whether your condition is an emergency, seek immediate medical attention or contact 911 rather than relying upon the KOOLMD platform.

KOOLMD's goal is to improve access to healthcare, promote health and wellness, facilitate appropriate medical evaluation, and connect patients with qualified healthcare professionals.

KOOLMD does not guarantee that any patient will receive a particular diagnosis, medication, prescription, treatment, referral, laboratory order, imaging order, work excuse, medical letter, or other healthcare service.

A healthcare professional independently determines whether a particular treatment, medication, prescription, diagnostic test, referral, or other service is medically appropriate based on the information available during the encounter and applicable professional standards and laws.

A request for a medication, including controlled substances, antibiotics, weight-management medications, GLP-1 medications, or any other prescription medication, does not create an entitlement to receive that medication.

Prescriptions, refills, medication changes, and treatment plans are subject to clinical judgment, medical history, allergies, medication interactions, contraindications, applicable law, professional standards, pharmacy availability, and other factors.

KOOLMD may provide access to healthcare professionals who evaluate patients for weight management, appetite management, metabolic health, and other conditions for which prescription medications may sometimes be considered.

No medication is guaranteed. A healthcare professional may determine that a medication is inappropriate, unnecessary, contraindicated, unavailable, or otherwise unsuitable for a particular patient.

Where GLP-1 medications or other weight-management therapies are considered, treatment decisions are individualized and may depend upon medical history, current medications, contraindications, clinical findings, eligibility requirements, and applicable law.

Results vary among individuals. KOOLMD does not guarantee weight loss, cardiovascular risk reduction, improvement in laboratory values, or any particular health outcome.

Patients should follow prescribed medication instructions and promptly report concerning symptoms or adverse effects to an appropriate healthcare professional. Serious or potentially life-threatening symptoms require emergency medical attention.

Telemedicine depends upon technology and information supplied by the patient. Healthcare professionals may not be able to perform a complete physical examination or obtain every diagnostic measurement that could be obtained during an in-person visit.

Technical problems, internet outages, device failures, poor connectivity, incomplete information, communication difficulties, or other circumstances may interfere with a telemedicine encounter.

A healthcare professional may terminate, postpone, reschedule, or redirect a telemedicine encounter when remote care is not clinically appropriate or when an in-person evaluation is necessary.

The patient remains responsible for providing complete and accurate information regarding symptoms, medications, allergies, medical history, diagnoses, pregnancy status where relevant, and other information requested during the healthcare encounter.

Healthcare involves uncertainty and inherent risks. Medical conditions can change unexpectedly, and no healthcare provider or technology platform can guarantee a particular outcome.

KOOLMD does not guarantee that the use of its services will prevent illness, produce a particular diagnosis, result in a particular treatment, prevent complications, improve a particular condition, or produce any particular medical outcome.

A patient's health may change before, during, or after a telemedicine encounter for reasons that may be unrelated to the services provided.

Nothing on the KOOLMD website, application, educational materials, artificial intelligence tools, messages, or other digital services should be interpreted as a guarantee of a particular health outcome.

KOOLMD may facilitate or coordinate access to laboratory testing, diagnostic testing, imaging services, specialist referrals, and other healthcare services.

Such services may be provided by independent third-party healthcare organizations, laboratories, imaging centers, pharmacies, specialists, hospitals, or other healthcare professionals.

KOOLMD does not control the availability, scheduling, performance, interpretation, accuracy, turnaround time, pricing, or clinical results of third-party services.

Patients should review laboratory and imaging results with an appropriately qualified healthcare professional. A result appearing in a patient portal does not necessarily mean that it has been reviewed or interpreted by a healthcare professional unless expressly indicated.

KOOLMD may, when clinically appropriate and permitted by applicable law, provide documentation such as work excuse letters, medical notes, treatment documentation, or other healthcare-related forms.

No letter, form, certification, disability documentation, time-off request, school excuse, employment documentation, or other documentation is guaranteed.

Such documentation is issued only when a healthcare professional determines that the information and clinical circumstances support it.

KOOLMD may connect patients with independent physicians, nurse practitioners, physician assistants, therapists, specialists, laboratories, pharmacies, imaging facilities, healthcare organizations, payment processors, technology providers, and other third parties.

Where healthcare professionals are independent providers, they maintain independent professional judgment and responsibility for the medical care they provide.

KOOLMD does not direct or control a healthcare professional's independent clinical judgment.

Third-party services may have separate terms, privacy policies, fees, requirements, availability limitations, and service conditions.

Patients are responsible for providing accurate, complete, and current information and for following reasonable instructions provided by their healthcare professionals.

Patients are responsible for seeking additional medical evaluation when symptoms persist, worsen, or change.

Patients should not delay, discontinue, or modify prescribed treatment solely because of information obtained from the KOOLMD website, application, educational materials, artificial intelligence tools, or other digital resources.

When instructed or advised to obtain in-person or emergency care, patients should do so promptly.

KOOLMD may use artificial intelligence and automated technologies to support administrative, educational, documentation, communication, or healthcare-related workflows.

AI-generated or automated information is intended to support—not replace—the judgment of qualified healthcare professionals.

AI tools may produce incomplete, inaccurate, outdated, or inappropriate information. Patients and healthcare professionals should not rely upon AI-generated information as a substitute for professional medical evaluation or emergency medical care.

Clinical decisions remain subject to appropriate healthcare professional review and independent clinical judgment.

KOOLMD takes the privacy and security of health information seriously and maintains privacy and security practices designed to comply with applicable law.

Where HIPAA applies, protected health information is handled in accordance with applicable HIPAA requirements and KOOLMD's Notice of Privacy Practices.

Our Notice of Privacy Practices explains how protected health information may be used and disclosed, patient privacy rights, applicable organizational responsibilities, and how patients may submit privacy complaints.

Additional state and federal privacy laws may apply depending upon the patient's location, the type of information involved, and the services provided.

Although KOOLMD uses reasonable administrative, technical, and organizational safeguards designed to protect information, no electronic communication or internet-based technology can be guaranteed to be completely secure.

Telehealth involves certain technology-related risks, including risks associated with internet connectivity, devices, software, telecommunications networks, unauthorized access, or circumstances outside KOOLMD's reasonable control.

Patients should participate in telehealth visits from a private location, use appropriate security practices, protect their login credentials, and avoid sharing account information with unauthorized persons.

Patients should not record a telehealth encounter unless permitted by applicable law and all required participants have provided appropriate consent.

KOOLMD cannot guarantee that information transmitted through the internet, telecommunications systems, electronic devices, third-party networks, or other technologies will never be intercepted, accessed, disclosed, altered, lost, or compromised.

KOOLMD will maintain safeguards required by applicable law and will respond to applicable privacy or security incidents in accordance with legal requirements.

Information appearing on the KOOLMD website, application, social media channels, educational materials, articles, videos, advertisements, newsletters, messages, or other communications is provided for general informational and educational purposes and is not, standing alone, a substitute for an individualized evaluation by a qualified healthcare professional.

You acknowledge that you are responsible for seeking emergency medical attention when appropriate and that KOOLMD is not an emergency service.

You understand that no particular diagnosis, medication, prescription, referral, laboratory order, imaging study, medical letter, treatment, or healthcare outcome is guaranteed.

You voluntarily choose to use telemedicine services after considering these limitations and risks.

If any provision of this notice, consent, disclaimer, or related agreement is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions shall remain in effect.

KOOLMD operates in a healthcare environment subject to federal and state laws and regulations. Telemedicine requirements, professional licensing requirements, prescribing rules, privacy requirements, informed-consent requirements, liability rules, and patient rights may vary by jurisdiction.

Where applicable law provides greater rights or protections to a patient than those stated in this document, the applicable law shall control.

KOOLMD may maintain state-specific telemedicine consent forms, privacy disclosures, notices, and terms where required.

KOOLMD may update this notice from time to time to reflect changes in services, technology, applicable law, regulatory requirements, or business practices.
